Terms of Service

These Terms of Service ("Terms") are the agreement between TrustCheck Nigeria Ltd. ("TrustCheck", "we", "us") and anyone who uses our website or asks us to carry out a verification (the "Client", "you"). By using our website, sending us a request or paying a quote, you agree to these Terms. If you do not agree, please do not use our services. Last updated: 8 October 2026.

In short: we check facts and report what we find. You must have a lawful reason for every check. Reports are not guarantees. Our liability is limited, and the rules for payment, refunds and disputes are below.

1. Meaning of key words

  • Assignment: a verification or due-diligence task we agree to carry out for you.
  • Quote: our written statement, by WhatsApp, email or other written message, of what will be checked, where, the expected turnaround and the fee.
  • Subject: any person, business, product, property or other thing we are asked to verify.
  • Report: the written findings, photographs and notes we give you for an Assignment.

2. Our services and how an Assignment starts

We provide physical verification, due-diligence checks and evidence-based reporting. An Assignment begins only when we confirm the Quote in writing and you have accepted it and paid any amount due before work starts. The Quote defines the scope. We carry out the agreed checks only. Our primary service areas are Lagos State, Ogun State and Ibadan (Oyo State). We operate nationwide on request: for any other location in Nigeria, send us a request and we will review it and provide a quotation, subject to the assignment requirements and the agreed service fee. Clients outside Nigeria may instruct us remotely; we confirm the scope, cost, turnaround and the digital channel for delivering the Report before work starts, and we may need to confirm your identity and payment before dispatch. If you want extra checks, we will agree them and the extra fee in writing first.

3. What we are, and what we are not

  • We are an independent verification company. We are not a police, intelligence, security or government agency, and we have no police powers.
  • We do not provide police clearance or guaranteed access to criminal records.
  • We do not give legal, financial, tax or investment advice, and we do not certify legal title to property. Where you need those, use a qualified professional such as a lawyer, surveyor or accountant.
  • We are not a credit bureau and do not provide credit reports.
  • We use lawful methods only. We do not trespass, force entry, record private places without permission, use false identities, hack, or access private accounts, devices or records.

4. What you promise us

By requesting an Assignment you promise that:

  • the information you give us is accurate and complete to the best of your knowledge, and you will tell us promptly if it changes;
  • you have a lawful and genuine reason for the check, such as a hiring, tenancy, purchase, payment, partnership or onboarding decision;
  • you are authorised to give us the details of every person or business you ask us to check, and you will make sure the Subject has been informed or has agreed where the law requires;
  • you will not use us or our Reports to stalk, harass, threaten, intimidate, blackmail, defame, unlawfully discriminate against or physically harm anyone, to trace someone who does not want to be found, to pursue unlawful debt collection, or for any criminal purpose; and
  • you will use each Report only for the decision it was requested for and will keep it confidential, as set out in clause 12.

5. Our right to refuse, pause or stop

We may decline, pause or stop an Assignment, with or without notice, if we reasonably believe it is unlawful, unsafe, unfair to a Subject, aimed at harm, based on false information, or impractical, or if you break these Terms or access is refused. We will tell you and explain what we did. Fees for work already done and costs already incurred remain payable, and we will refund any balance that has not been used.

6. Field safety and access

Our field representatives are instructed not to enter private property without permission, not to put themselves in danger, and to withdraw if they are threatened, if access is refused, or if conditions are unsafe. Weather, security conditions, roadblocks, holidays, Subject availability, and third parties not responding can affect what can be confirmed and how long it takes.

7. Fees and payment

  • Fees depend on location, complexity, number of checks and turnaround. We give a Quote before work begins. Third-party costs such as travel to remote locations, official search fees or courier charges are included in the Quote or agreed in writing first.
  • Unless the Quote says otherwise, payment, or a deposit stated in the Quote, is due before we dispatch a field representative. The balance is due when we deliver the Report.
  • Fees are in Nigerian Naira unless the Quote says otherwise. Taxes that apply are added where the law requires.
  • Protect yourself from fraud: pay only to account details written in our Quote and confirmed with us through the WhatsApp number or email address shown on this website. We will never ask you to pay into an unrelated personal account without confirming the details through those channels. If anything looks different, stop and contact us before you pay.

8. Turnaround

Turnaround times in a Quote are estimates, not guarantees. We will tell you promptly if we expect a delay.

9. Cancellations and refunds

  • Before dispatch: you may cancel and we will refund what you paid, less any costs we have already incurred and a reasonable administration charge stated in the Quote.
  • After dispatch or once work has started: fees for work done and costs incurred are not refundable. We will refund any part of the fee that relates to checks not yet started.
  • If we fail to carry out an agreed check through our own fault, we will repeat it at no extra charge where it is practical, or refund the fee for that check.
  • "Could not confirm" is a finding, not a failure. If a fact could not be confirmed after reasonable effort, for example because a person or business could not be found or access was refused, we report that and the fee remains payable.
  • Refunds are paid to the account the payment came from, normally within 14 working days.
  • Nothing here limits any right you have under consumer protection law that cannot be excluded.

10. What our Reports are

A Report states what could be confirmed from information, documents, references and physical observation available at the time of the Assignment. It reflects a moment in time. It does not predict future conduct or product performance, does not find hidden defects, and does not remove all risk. A Report is not legal advice, police clearance, a legal title certificate, a guarantee or a recommendation to enter or avoid a transaction. Information given by referees, neighbours and other third parties is their account, which we record but cannot always independently prove. The decision you make is yours.

11. Reliance

Reports are prepared for the Client only and for the stated purpose. No other person may rely on a Report. We owe no duty to anyone other than the Client.

12. Confidentiality and use of Reports

  • We keep your information confidential and use it only for the Assignment, as described in our Privacy Policy and Data Protection Notice.
  • You must keep each Report confidential. You may share it with your own directors, staff, lawyers and professional advisers who need it, or where the law requires. You must not publish a Report or post its findings online or on social media, and you must not use it to shame or harass a Subject.
  • You are responsible for lawful handling of any personal data in the Report once you receive it, including keeping it secure and deleting it when you no longer need it.
  • These duties continue after the Assignment ends.

13. Evidence and records

We keep Report files, photographs and notes for the period stated in our Privacy Policy, and may keep them longer if needed for a dispute, claim or legal duty. We may use them to defend ourselves or enforce our rights.

14. Intellectual property

The TrustCheck name, logo, website content, report format and materials belong to TrustCheck or its licensors. You may not copy, adapt or use them for your own commercial purposes without our written permission. We grant you a limited, non-exclusive licence to use each Report for the purpose stated in clause 12. Photographs and recordings taken for an Assignment are included in that licence for the same purpose only.

15. Our team and associates

We may carry out work through employees, field representatives and trusted associates. They act under our instructions and confidentiality duties. We remain responsible to you for the Assignment as set out in these Terms.

16. Limits on our liability

To the fullest extent the law allows:

  • we are not liable for any loss, damage, cost or claim that results from a decision you make, or fail to make, using a Report or any information from us;
  • we are not liable for events that happen after the date of the check, or for fraud, dishonesty or defects that could not reasonably be found through the agreed checks;
  • we are not liable for indirect or consequential loss, loss of profit, loss of opportunity, loss of business or goodwill, or loss of expected savings;
  • we are not liable for delay or failure caused by events outside our reasonable control (clause 18), by information you or others give us that is false or incomplete, or by a Subject, authority or other third party refusing access or not responding; and
  • our total liability to you for all claims arising from one Assignment, whether in contract, negligence or otherwise, is limited to the fee you paid us for that Assignment.

Nothing in these Terms limits or excludes liability for fraud, for death or personal injury caused by our negligence, or for anything else that cannot lawfully be limited or excluded.

17. Indemnity

You agree to compensate us for loss, claims, penalties and reasonable legal costs we suffer or pay because you gave us false or unlawful instructions, broke clause 4 or clause 12, or used a Report in a way these Terms do not allow, including where a Subject or authority makes a claim against us for that reason.

18. Events outside our control

Neither of us is in breach for delay or failure caused by events beyond reasonable control, such as natural disasters, flooding, civil unrest, strikes, security operations, curfews, government restrictions, fuel shortages, transport or telecommunications failures and internet outages. We will tell you as soon as we reasonably can and agree a new date, or refund the unused part of the fee if the Assignment cannot be completed.

19. Website use

  • Our website is for lawful use. You must not attempt to break, overload, scrape or gain unauthorised access to it, or send us harmful content.
  • Articles, guides, examples and sample reports are general information and illustrations only. They are not advice, and a sample report is not a real result.
  • We try to keep the website accurate and available but do not promise it will be error-free or always available.
  • Client reviews are opinions of the people who gave them, shared with their permission. They are not a guarantee of any outcome, and your result may differ.
  • Links to other websites are provided for convenience. We are not responsible for their content.

20. Communicating with us

You agree that we may contact you by phone, WhatsApp, email and similar electronic means about your request. Written messages on those channels, including accepting a Quote, count as writing. Messaging platforms are run by third parties and are not perfectly secure; please do not send passwords or bank card details. Do not rely on a message from any number or address other than those shown on this website.

21. Complaints

If you are unhappy with our service, email trustchecknigerialtd@gmail.com with your name, the Assignment and what went wrong. We will acknowledge within three working days and aim to resolve it within 14 working days.

22. Disputes and governing law

These Terms are governed by the laws of the Federal Republic of Nigeria. If a dispute arises, we will first try to resolve it through direct discussion for 14 days after written notice. If that fails, either of us may refer it to mediation, and if mediation does not resolve it within 30 days, to arbitration in Nigeria under the Arbitration and Mediation Act 2023, before a single arbitrator agreed between us (or appointed under that Act if we cannot agree). Either of us may go to the courts of Nigeria to obtain urgent relief or to enforce an award. Nothing here removes any right you have under consumer protection law to bring a complaint to the proper authority.

23. General

  • Whole agreement: these Terms and the Quote are the whole agreement for an Assignment. If they conflict, the Quote prevails on scope, fee and timing.
  • If a part is invalid, the rest continues to apply.
  • No waiver: not enforcing a right straight away does not mean we have given it up.
  • Transfer: you may not transfer your rights or duties under an Assignment without our written consent. We may transfer ours to a successor of our business.
  • No partnership or agency: nothing here makes either of us the partner, agent or employee of the other.
  • Third parties have no right to enforce these Terms.

24. Changes

We may update these Terms. The version on this page on the day you place a request applies to that Assignment. Continued use of the website after a change means you accept the update.
